Terms of Service

1. Acceptance of Terms

By creating an account or using LinguistPro, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service. These terms are governed by the laws of the Republic of South Africa.

LinguistPro is operated by Tech Sight (Pty) Ltd. References to "we", "us", or "our" mean Tech Sight (Pty) Ltd.

2. Description of Service

LinguistPro provides AI-powered audio and video transcription services, including speaker diarisation, export to DOCX and SRT, and AI-generated summaries available to all signed-in users. The service supports 13 live languages — English and Afrikaans plus 11 global languages (Arabic, Chinese, French, German, Hindi, Italian, Japanese, Korean, Dutch, Portuguese, and Spanish) — and five South African indigenous languages (isiZulu, isiXhosa, Sesotho, Setswana, and Tshivenda) in beta as a best-effort offering powered by Gemini.

We reserve the right to modify, suspend, or discontinue any part of the service with reasonable notice.

3. Account Responsibilities

• You must provide accurate registration information and keep it up to date.
• You are responsible for maintaining the confidentiality of your password.
• You must be at least 18 years old to create an account.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at info@techsight.co.za if you suspect unauthorised access.

4. Billing & Payments

LinguistPro offers three pricing tiers:

• Free: 30 minutes of transcription per calendar month, reset on the 1st of each month.
• Pay-As-You-Go (PAYG): R7.50 per hour, VAT inclusive (R0.125 per minute). From 23 November 2026 a job is charged at least 40 minutes of balance for each file and transcription run (a re-run in another language is charged again); balance you paid for before that date is charged by the minute. A failed job is not charged. Balance is deducted after each transcription job. Unused balance does not expire.
• Pro: an unlimited monthly plan is coming soon and is not currently on sale.

All prices are in South African Rand (ZAR) and include VAT where applicable. Payments are processed securely by PayFast. We do not store card details.

Top-up credits are non-refundable once purchased except in the case of a demonstrable billing error.

5. Acceptable Use

You agree not to use LinguistPro to:

• Transcribe audio you do not have the right to record or process.
• Upload content that is unlawful, defamatory, or infringes third-party intellectual property rights.
• Attempt to reverse engineer, scrape, or otherwise misuse our API.
• Circumvent usage limits or impersonate another user.
• Use the service for bulk commercial surveillance or mass data collection without written consent.

Violation of these terms may result in immediate suspension of your account without refund.

6. Intellectual Property

You retain full ownership of your audio files and the transcripts generated from them. By uploading audio, you grant us a limited licence to process the content solely to provide the transcription service.

The LinguistPro platform, including its UI, branding, and software, is the intellectual property of Tech Sight (Pty) Ltd and may not be copied or reproduced without written permission.

7. Disclaimer of Warranties

LinguistPro is provided "as is" without warranties of any kind. We do not guarantee the accuracy of transcriptions — AI transcription is probabilistic and may contain errors, particularly for heavily accented speech, background noise, or technical terminology. You are responsible for reviewing and correcting transcripts before relying on them for business or legal purposes.

8. Limitation of Liability

To the fullest extent permitted by South African law, Tech Sight (Pty) Ltd shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the service. Our total liability for any claim is limited to the amount you paid us in the 3 months preceding the claim.

9. Privacy

Your personal information is processed in accordance with our Privacy Policy. By using LinguistPro, you consent to such processing and you warrant that all information you provide is accurate.

10. Termination

You may close your account at any time from your Profile page. We may terminate or suspend your account if you violate these terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Changes to These Terms

We may update these terms from time to time. We will notify you by email of material changes where possible. Continued use of the service after changes constitutes acceptance of the revised terms.

12. Governing Law & Disputes

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa. If you have a complaint, please contact us first at info@techsight.co.za so we can attempt to resolve it informally.
